The former personal attorney for Donald Trump has resigned as New Jersey's top federal prosecutor. This comes after a court battle that questioned her right to occupy the role.

Acceptance of Resignation

The head of the Justice Department, Pam Bondi, announced the prosecutor's departure on the start of the week. Bondi stated that the court's "flawed" ruling made it "untenable" for her to effectively run her office.

"But do not mistake compliance for surrender," she declared. "The effort will now stretch across America."

Legal Background

Her resignation was triggered by a federal appellate panel ruled that she had been serving in violation of the law as the federal prosecutor. This ruling is likely to affect many prosecutions in the Garden State.

The appellate judges said that a interim role that bypassed Senate approval ran afoul of the federal law governing appointments.

Bondi said that Habba will remain at the Department of Justice as a top consultant. She will pursue additional appeals of the ruling, in the hope of achieving a reversal.

On a social media platform, Bondi wrote that the judiciary "should not be able to override the executive's selection of lawyers responsible for carrying out the executive branch's core responsibility of criminal prosecution."

Bondi praised Habba's record and pointed out that during her run, the state capital of Newark saw a one-fifth decrease in offenses. It was also reported that the city of Camden recorded its first summer in 50 years without a homicide.

Legal Career

Habba, 41, was initially recruited to Donald Trump's lawyers in recent years. She later defended her client in his business records case in 2024, when he was conviction on 34 counts of document fraud.

Before Habba took on the top New Jersey post, Trump had stated he was selecting her as his presidential counsellor during his second administration, labeling the lawyer as deeply loyal and a dedicated fighter for justice.
